Initial Comments:

Based on the findings of an onsite Complaint Investigation Survey completed 02/27/2024, Independence Care Of Erie, LLC was found to be in compliance with the requirements of PA Code, Title 28, Health and Safety, Part IV, Health Facilities, Subpart A, Chapter 51.

Based on the findings of an onsite Complaint Investigation Survey completed 02/27/2024, Independence Care Of Erie, LLC was found not to be in compliance with the requirements of PA Code, Title 28, Health and Safety, Part IV, Health Facilities, Subpart H, Chapter 611, Home Care Agencies and Home Care Registries.

Consumer Rights

(a) The consumer of home care services provided by a home care agency or through a home care registry shall have the following rights: (1) To be involved in the service planning process and to receive services with reasonable accommodation of individual needs and preferences, except where the health and safety of the direct care worker is at risk. (2) To receive at least 10 calendar days advance written notice of the intent of the home care agency or home care registry to terminate services. Less than 10 days advance written notice may be provided in the event the consumer has failed to pay for services, despite notice, and the consumer is more than 14 days in arrears, or if the health and welfare of the direct care worker is at risk.

Observations:


Based on a review of consumer files (CF) and staff (EMP) interview, the agency failed to demonstrate that consumers received services with reasonable accommodation of individual needs and preferences for one (1) of three (3) CFs reviewed (CF1).

Findings include:

Review of CR1 on 2/27/2024 between approximately 10:00 a..m. and 12:00 p.m. (SOC 3/15/2022) revealed "HHAeXchange - Patient Visit Authorization... From 12/12/2023... To 2/07/2023... Auth Units (Hours) 746" which is the equivalent of 18 hours per day. Agency provided "HHAeXchange Calendar" which showed services were provided as authorized from 1/01/2024 through 2/02/2024. Agency also provided "HHA Exchange - Patient Visit Notes... Date 02/05/2024... Notes... CG (Caregiver) informed that she is not able to work anymore because she has to take care of her family... informed the client and SC (Service Coordinator)... we are looking for a replacement". The aforementioned "HHAeXchange Calendar" showed missed visits for the first shift: 0900-1730 on 2/05/2024, 2/06/2024 and 2/07/2024.

Interview on 2/29/2024 at approximately 11:00 a.m. via telephone with EMP1 confirmed the above findings. When asked "did CR1 disclose any informal support?" EMP1 replied "No"

























































Plan of Correction:

The Office Administrator will review all patient profiles to ensure a informal support is associated with each participant. The Agency will ensure the informal support is always contacted whenever there is a call off or an anticipated missed visit. The office administrator will also review edited authorizations in real time to ensure the adequate adjustment has been made to the patients calendar or plan of care. Lastly, Admission packets will be reviewed weekly to ensure an informal support has been documented.
